1. Introduction

1.1 These terms govern consumer purchases of goods in the online store caniondog.com.

1.2 Consumer purchases over the Internet are primarily regulated by the Norwegian Contracts Act, Consumer Purchase Act, Marketing Act, Right of Withdrawal Act and E-commerce Act.

1.3 These laws give you as a consumer rights that cannot be waived to your disadvantage. Mandatory consumer protection rules in your country of residence are not affected.

2. Agreement

2.1 The agreement consists of these terms, the information provided during the ordering process, and any separately agreed terms.

3. Parties

3.1 Seller:
Canion AS
Malangsveien 707, 9055 Mestervik, Norway
info@caniondog.com
Org. no.: NO 824 525 722 MVA

3.2 Buyer:
The person placing the order.

4. Price

4.1 The total shown at checkout is the full amount you pay before the order is shipped. Duties and import taxes are settled at checkout and paid by us when the goods are shipped, so there is nothing extra to pay on delivery.

4.2 Shipping costs are shown at checkout before you complete the order. Delivery times and other shipping terms are described in our Shipping Policy.

5. Formation of Agreement

5.1 The agreement is binding for both parties once the buyer has submitted the order.

5.2 However, the agreement is not binding if there has been an obvious typing or pricing error in the offer in the online store or in the buyer's order, and the other party realized or should have realized the error.

6. Payment

6.1 The seller may demand payment for the item from the day it is shipped to the buyer.

6.2 If the buyer pays by credit or debit card, the seller may reserve the purchase amount on the card at the time of ordering.

6.3 The card is charged on the day the order is shipped.

7. Delivery

7.1 Delivery has taken place when the item has been handed over to the buyer or their representative, or made available for pickup and the buyer has been notified.

7.2 Unless otherwise stated during the ordering process, the seller delivers the item without undue delay and no later than 30 days after the order. Expected delivery times are listed in our Shipping Policy.

7.3 For pre-orders, the estimated delivery time is stated at the time of ordering, and any delay is communicated to the buyer at least one week before the expected delivery date.

7.4 The item is delivered to the delivery address given in the order or to a pickup point.

8. Risk for the Item

8.1 The risk for the item passes to the buyer when the buyer or their representative has received it.

9. Right of Withdrawal

9.1 The buyer may withdraw from the purchase within 30 days after receiving the item, in accordance with the Right of Withdrawal Act and the seller's extended return policy.

9.2 The right of withdrawal applies to all products sold on caniondog.com, including custom-made and customized products. This extended right of withdrawal is a voluntary policy offered by the seller and applies in addition to the buyer's statutory rights.

9.3 The buyer must notify the seller of the decision to withdraw within 30 days from the day after receiving the item.

9.4 The buyer pays the cost of returning the item. On request, the seller can provide a prepaid return label. The price of the label is stated before it is sent, and the amount is deducted from the refund. The item must be returned unused and in its original packaging.

9.5 The buyer may examine and try the item carefully to determine its nature, characteristics and function without losing the right of withdrawal.

9.6 The seller refunds the purchase amount without undue delay once the returned item has been received and inspected, and no later than 14 days after receiving it.

9.7 Returns from outside Norway: To make the return easy and to make sure the customs paperwork is correct, the seller sends the buyer a prepaid return label with the customs documents filled in. The cost of the return shipping is stated before the label is sent and is deducted from the refund. If the buyer nevertheless chooses to send the item without this label, all shipping costs must be prepaid by the buyer, and the customs form (CN22/CN23 or commercial invoice) must state: Contents: Dog harness – returned goods (or a corresponding description of the item) · HS code: 4201.00 · Country of origin: Norway · Value: the original purchase price · Reason: Return – right of withdrawal. The order number must be written on the parcel or included inside it. If the carrier charges the seller for shipping, duties or taxes on receipt, these costs are deducted from the refund.

9.8 Return address:

VAT NO 824 525 722 MVA

10. Delay and Non-Delivery

10.1 If the seller fails to deliver the item, or delivers it unreasonably late according to the agreement, and this is not due to the buyer or circumstances on the buyer's side, the buyer may terminate the agreement.

11. Fulfillment

11.1 In case of delayed delivery, the buyer may uphold the purchase and demand fulfillment.

11.2 The buyer cannot demand fulfillment if there is an obstacle the seller cannot overcome, or if fulfillment would cause the seller inconvenience or cost that is disproportionate to the buyer's interest in fulfillment.

11.3 If the difficulties are resolved within a reasonable time, the buyer may still demand fulfillment.

11.4 The buyer loses the right to demand fulfillment if the claim is unreasonably delayed.

12. Defects – Complaints

12.1 If the item has a defect, the buyer must notify the seller within a reasonable time after discovering, or when the buyer should have discovered, the defect.

12.2 A complaint made within 2 months of when the defect was or should have been discovered is always made in time.

12.3 Complaints can be made up to two years after the buyer took possession of the item.

12.4 Defects resulting from incorrect use contrary to the user manual do not give a right to complain.

12.5 Complaints must be made in writing.

13. Rectification or Replacement

13.1 In the case of a valid complaint, the seller may, where possible, rectify the defect by repairing or replacing parts rather than replacing the entire product.

13.2 The seller may refuse the buyer's request if fulfilling it is impossible or would cause unreasonable costs.

13.3 Rectification or replacement is carried out within a reasonable time.

14. Price Reduction

14.1 If the item is neither rectified nor replaced, the buyer may demand an appropriate price reduction.

15. Termination

15.1 If the item is neither rectified nor replaced, the buyer may also terminate the purchase when the defect is significant.

16. Seller's Rights in Case of Buyer's Breach

16.1 If the buyer fails to pay or fulfill other obligations under the agreement or the law, and this is not due to the seller, the seller may withhold the item and demand fulfillment.

16.2 If the seller sets a reasonable additional deadline and the buyer does not pay within it, the seller may terminate the purchase.

16.3 If the purchase requires special customization of the item or involves a larger volume, the seller may claim compensation if the buyer does not pay or fulfill other obligations.

16.4 Under certain circumstances the seller may also demand interest for late payment, collection fees and a reasonable fee for uncollected goods.

17. Pre-Ordered Items

17.1 The seller may uphold the purchase and demand payment if the buyer has placed a pre-order.

17.2 The seller loses this right if the claim is unreasonably delayed.

17.3 If the item has not been delivered within a reasonable time after the agreed delivery date, the buyer may terminate the agreement.

18. Interest for Late Payment and Collection

18.1 If the buyer does not pay according to the agreement, the seller may demand interest under the Norwegian Late Payment Interest Act.

18.2 In case of non-payment, and after prior notice, the claim may be sent to debt collection, and fees under the Norwegian Debt Collection Act may apply.

19. Fee for Uncollected Non-Prepaid Goods

19.1 If the buyer fails to collect unpaid goods, the seller may charge a fee.

19.2 The fee covers no more than the seller's actual costs of delivering the item.

19.3 No such fee can be charged to buyers under 18.

20. Warranty

20.1 A warranty from the seller or manufacturer gives the buyer rights in addition to those granted by mandatory law.

20.2 A warranty does not limit the buyer's right to claim for delay or defects.

21. Personal Data

21.1 The seller is the data controller for collected personal data.

21.2 Unless the buyer consents otherwise, the seller only collects and stores the personal data needed to fulfill the agreement.

21.3 Personal data is only disclosed to others when necessary to fulfill the agreement or required by law. See our Privacy Policy for details.

22. Conflict Resolution

22.1 Complaints should be directed to the seller within a reasonable time after the buyer discovered, or should have discovered, the defect.

22.2 The parties should attempt to resolve any disputes amicably.

22.3 To the extent permitted by law, legal disputes are resolved by the courts at the seller's place of business.

23. Use of the Products

23.1 Our products are used at your own risk. Always check the product for wear and damage before use, and do not use a product that is damaged or worn.

23.2 We are not liable for failure, injury or damage caused by incorrect use, use contrary to the instructions, or normal wear and tear.

23.3 This does not limit your rights under mandatory consumer law, including your right to complain about defects.
